Driver’s License Suspension Relief

 

If you’ve recently been involved in a vehicle accident with no insurance and a judgement against you has been entered, please read the following: Florida Statute sec. 324.121 provides that your driver's license will be suspended by the Florida Department of Highway Safety and Motor Vehicles if you fail to satisfy the judgment. 

Good News: You have options. 


Your first option involves reaching an agreement with the insurance company of the other driver; this often involves a payment plan. Once this agreement is reached, the insurance company will give you documentation to take to the DMV to release your suspension. However, in many cases the insurance company will demand a hefty down-payment or expensive monthly payments. If this happens, Florida Law provides a procedure that allows you to petition the Court that entered the Judgement for a reasonable payment plan to satisfy the judgement. This procedure will require supporting documentation and a possible Court appearance.

A second option is to seek relief from the United States Bankruptcy Court.  You have a constitutional right to file for bankruptcy protection and the discharge issued from the Bankruptcy Court will allow you the right to demand the reinstatement of your driver's license.
